I would like to make a gift to BEN in my will. What information do I need to include?

What happens if I don't have a will?
If you do not leave a will, you cannot ensure your assets are distributed as you would wish. Your assets may be distributed according to the Rules of Intestacy. BEN has included a flow chart detailing the rules of intestacy in our
legacy pack to help you.
Who should write my Will?
To ensure your will is legally correct, it is best to consult a solicitor. If you are over 60 you may be eligible for BEN's free will service. For further details please contact Alfred Friday on 01344 620191 or email

Can a gift to charity help me pay less tax?
Depending on the value of your estate, inheritance tax may be payable, (the rules regarding this can change with the Chancellor's budget). Charitable bequests are generally exempt from inheritance tax, so with careful planning you may be able to reduce the potential inheritance tax liability. It is best to discuss tax planning with your solicitor.
Can BEN be my executor?
The role of an executor is both exceptionally demanding and responsible. This is unfortunately something that BEN does not have the resources to do at the present time. It is perhaps worth considering your solicitor, close family or friends for this.
Can I specify how BEN uses my money?
BEN's work is extremely varied and very much dependent on the needs of those who require our help most. BEN's help and care in our centres is constantly evolving and improving. It is generally not advisable to be too specific in you Will about how exactly you would like your money to be spent, it is best if gifts are made unconditionally. To enable you gift to be of greatest benefit to BEN, we ask you to trust us to use it where it is most needed. It would be devastating if we were unable to accept or use your gift because a specific request was no longer relevant.
If I have left a gift to BEN I my will, should I tell you?
Yes, if you have included BEN in your will it would be really helpful if you let us know. That way, we can keep you up to date with BEN, and how our help is improving the lives of so many beneficiaries across the country. Plus, it gives us the opportunity of thanking you for your kind generosity.
